Terms and Conditions
1. SALE AND PURCHASE OF GOODS
Nandi By Banaras's parent company, Banaras Sarees ("Seller"), hereby agrees to sell, and You ("Buyer") hereby agree to purchase, the goods described and quantified on the Checkout page ("Checkout"), which are incorporated herein by reference ("Goods"), on the terms and conditions set forth in this Agreement.
2. PURCHASE PRICE
Buyer agrees to pay the purchase price of the Goods as displayed on this website at the time of Checkout.
3. PAYMENT TERMS
The total purchase price shall be payable in full by the Buyer on or before the payment due date stated at Checkout. In the event of non-payment, the Seller shall have the right to pursue any remedies available under applicable law or as provided herein and shall be entitled to recover all reasonable costs of collection, including legal fees, attorney's fees, court costs, and other related expenses.
4. DELIVERY
Unless otherwise agreed to in writing, delivery shall be made in accordance with the Seller's Shipping Policy in effect on the date of shipment. Delivery dates provided by the Seller are estimates only. While the Seller will make reasonable efforts to deliver within the estimated timelines, the Seller shall not be liable for any delay in delivery. Unless otherwise agreed in writing, the Goods shall be packaged in accordance with the Seller's standard practices.
5. CUSTOMS, DUTIES, AND TAXES
The recipient is responsible for ensuring that the product can be lawfully imported into the destination country. When ordering from Nandi By Banaras, the recipient is considered the importer of record and must comply with all applicable laws and regulations of the destination country.
Orders shipped outside India may be subject to import duties, customs fees, taxes, and other charges imposed by the destination country.
Customs policies vary from country to country. The recipient is advised to contact their local customs office for information regarding applicable procedures and formalities. Customs clearance procedures may cause delays beyond our estimated delivery timelines.
Where required, the recipient must provide a Social Security Number, Tax Identification Number, proof of address, business registration, or any other documentation requested by the local customs authorities to facilitate customs clearance.
6. DISCLAIMER OF WARRANTY / LIMITATION OF LIABILITY
Except as expressly provided in this Agreement, the Seller makes no warranties or representations regarding the quality, merchantability, fitness for a particular purpose, or suitability of the Goods and expressly disclaims all other warranties and conditions, whether express or implied, to the fullest extent permitted by applicable law.
7. COLOUR DISCLAIMER
The colours of the products displayed on your screen may vary slightly from the actual product. Variations may occur due to differences in monitor settings, screen calibration, display technologies, lighting conditions during photography, and the natural characteristics of fabrics. Such variations shall not be considered defects.
8. PRICE DISCLAIMER
While Nandi By Banaras makes every effort to ensure that all products are accurately described and priced, in the event of a pricing error, Nandi By Banaras reserves the right to cancel or refuse the sale of the affected item, even after an order has been placed.
9. GIFT CARDS
Nandi By Banaras Gift Cards are non-refundable and cannot be cancelled once issued.
The issuance of a Gift Card to the designated recipient constitutes full and final fulfilment of the purchaser's order.
Once issued, Nandi By Banaras shall not be responsible for the loss, misuse, unauthorised use, or redemption of the Gift Card by the recipient or any third party.
10. FORCE MAJEURE
The Seller shall not be liable for any failure or delay in performing its obligations or delivering the Goods where such failure or delay arises from causes beyond its reasonable control, including but not limited to governmental actions, laws, regulations, strikes, labour disputes, fire, flood, natural disasters, war, pandemics, transportation delays, shortages of raw materials, fuel, electricity, water, labour, or any other event constituting force majeure.
The Seller shall determine in good faith the extent to which such circumstances affect its ability to perform its obligations.
11. GENERAL
The Buyer may not assign or transfer this Agreement without the prior written consent of the Seller.
This Agreement constitutes the entire understanding between the parties concerning the sale of the Goods. In the event of any inconsistency between this Agreement and any other agreement relating to the Goods, this Agreement shall prevail.
No amendment or modification to this Agreement shall be valid unless made in writing and signed by the Seller.
Any additional or modified terms submitted by the Buyer shall be deemed null and void unless expressly accepted by the Seller in writing.
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
12. COPYRIGHT
All content available on this website, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, software, and other materials, is the property of Nandi By Banaras or its licensors and is protected by applicable intellectual property laws.
The compilation of all content on this website is the exclusive property of Nandi By Banaras.
13. TRADEMARKS
Your use of the official Nandi By Banaras website does not grant you any rights in relation to any copyrights, trademarks, trade names, designs, logos, software, HTML code, or any other intellectual property displayed on or contained within this website.
Any unauthorised use, reproduction, or infringement of Nandi By Banaras' intellectual property may result in legal action.
14. BILLING
All prices displayed on the website are inclusive of applicable GST unless otherwise stated.
The applicable tax rate shall be determined based on the shipping destination and in accordance with applicable Indian tax laws.
Nandi By Banaras reserves the right to collect shipping charges and any applicable taxes on such charges wherever required.
15. REFUNDS WILL NOT BE PROVIDED UNDER THE FOLLOWING CIRCUMSTANCES
• The shipping address provided by the customer is incorrect or incomplete.
• The product has been used, worn, altered, washed, or damaged after delivery.
• The product has already been dispatched and is in transit.
• The customer fails to comply with the Return & Exchange Policy.
• The return request does not satisfy the eligibility criteria specified in our policy.
If a customer is charged twice for the same transaction, the duplicate payment shall be refunded to the original payment method within 20 working days after verification.
